Title: “Examining Armed Robbery Charges in Wisconsin, California, and Louisiana: The Case of Joe Smith and the Toy Gun”

Your client, Joe Smith, is charged with Armed Robbery. The police reports read as follows:
The teller told police that Smith entered the savings and loan, pulled out a gun, pointed the gun at her, gave her a note stating “This is a hold-up,” and told her not to pull the alarm or he would shoot. She also stated that it was a small-type handgun, gray-black in color; that she was not familiar with guns; and that she thought the gun was real.
After police arrested Smith, they determined that Smith’s gun was actually a toy gun and was not capable of firing real bullets. 
Smith does not think that he should be convicted of Armed Robbery when he only used a toy gun.
